Terms and conditions of the Sevda app

 

These Sevda Application Terms and Conditions ("Terms and Conditions") govern your access to the Sevda application and any information, links, text, images, photos, audio, video, and other materials downloaded or made available through the Sevda application ("Content"). By accessing or using the application, you expressly acknowledge and agree to be bound by these Terms and Conditions.

 

The terms and conditions of the provision as well as any dispute or claim relating thereto shall be governed by and construed in accordance with the laws of Turkey. If the original version and its translation into another language do not match, the original version shall take precedence.

 

Who can use Sevda

 

You may use the Sevda App only if you agree to enter into a legally binding agreement with Amarena Software and are not prohibited from using the App in accordance with the laws of the relevant jurisdiction.

 

By accepting these Terms and Conditions and using the application you represent and warrant that you have proper authority to express your consent to these Terms of Service.

 

You can only use Sevda and register with the app if you are at least 13 years old (or older if the law in your country of residence specifies a higher age).

 

By accepting the terms, you confirm that you have the right to use the application and are able to bind yourself to comply with these Terms and Conditions. You confirm that you will not violate the laws and regulations of your country by using Sevda.

 

What content can be posted in Sevda

 

You are responsible for your use of Sevda and for all Content you provide. You are responsible for complying with these Terms and Conditions and all laws, rules and regulations. 

 

You can post anything on Sevda, including messages, photos, audio files, video files, images and other content.

 

However, there are rules regarding the content allowed in the application.

 

In the Sevda app, you must not post, send or upload Content that

 

• is pornographic or indecent;
• contains swear words or insults;
• contains threats;
• contains scenes of violence;
• incites violence, self-harm, intolerance, suicide, racism, sexism, hatred;
• calls for the conduct of illegal, unlawful activities such as terrorism, racial hatred;
• is slander;
• refers to commercial activities (e.g. selling services, advertising, links to other websites for the purpose of selling);
• contains spam;
• portrays another person, brand or company to deceive or confuse people;
• contains spyware, adware, viruses, worms or other malicious code;
• contains Trojan horses ;
• Contains content that infringes third party rights (including, without limitation, intellectual property rights);
• shows another person if the Content was created or distributed without that person's knowledge and without giving that person an opportunity to opt out of its creation or distribution.

 

 

We do not endorse, represent or warrant the completeness, truthfulness, accuracy or reliability of any Content or messages posted by our users via Sevda.

 

You should be aware that when using Sevda you may be exposed to Content that you may find offensive, harmful, untrue or otherwise unacceptable.

 

All responsibility for the Content lies with the creator and distributor of that Content. We are not responsible for the Content of our users, but we systematically check posts and accounts for Content that violates these terms.  We reserve the right not to monitor or control all Content posted using Sevda.

 

We have the right to remove Content that violates the Sevda App Terms of Use, including, for example, copyright, trademark or other intellectual property rights infringements, impersonation, unlawful conduct or harassment.

 

We have the right to disclose your personal information to a third party if we receive a complaint that Content uploaded by you to Sevda violates their copyright, right of privacy or any other law.

You can use the personal data of other Sevda users to the extent necessary to get to know and talk to them. You may not use personal data for commercial purposes, to threaten, spam or harassment.

 

If you systematically violate the rules, we may suspend you from using Sevda by blocking your account temporarily or permanently. We may also remove material you have posted if we believe it is illegal.

 

We also have the right to sue you for any damage we cause, such as fraud or hacking.

 

Using the Sevda app

 

Licence to use

 

You may only use Sevda in accordance with these Terms and Conditions and all applicable laws, rules and regulations in your country.

 

Amarena Sofrware grants you a personal, global free, non-assignable and non-exclusive licence to use the Sevda application.

 

This licence is for the purpose of enabling you to use the application and its benefits in the manner set out in these Terms and Conditions.

 

Disclaimer

 

Our app is constantly evolving, so it may change from time to time at our discretion.

 

We cannot guarantee that our app will always be available 24/7. Sometimes we have to carry out technical work. Unforeseen problems may also occur with the application. Should defects in Sevda be detected, we will make every effort to rectify the problems as quickly as possible.

 

Sevda application services are provided on an "as is" and "as available" basis. We make no warranties regarding the functionality, quality, accuracy, availability or performance of Sevda. We may suspend, disable, supplement or modify services provided by Sevda without notice or obligation to users.

 

You use Sevda and the Content available on Sevda at your own risk.

 

Amarena Software makes no representations or warranties and disclaims all liability and responsibility for:

• the completeness, accuracy, availability, timeliness, security or reliability of Sevda or any Content posted on the application;
• any damage to your device, loss of data or other harm resulting from your access to the Sevda App and Content;
• deletion, inability to store or transfer the Content carried out in the Sevda application;
• Sevda meets your requirements or is available on a continuous, secure and error-free basis.

 

 

Your task is to ensure your access to Sevda (including internet payments and a properly working mobile device). We will not be liable if the functionality of Sevda is impaired as a result of a poor connection or a defective device.

 

By accessing Sevda, you agree that you will be able to see Content posted by other users to the public domain as well as advertisements posted by us on the app.

 

 

Content rights in the Sevda app

 

All Content (other than User Submissions) such as text, graphics, user interface, trademarks, logos, sounds and artwork are the property of Amarena Software and are controlled or licensed by us and therefore protected by copyright, trademark and other intellectual property rights.

 

Nothing in these Terms and Conditions shall authorise you to use the Sevda name or trademarks, logos or other distinctive brand features.

 

If you own the content you upload, you do not lose rights to it.

 

If you upload Content to Sevda, you confirm that

• you are the author and owner of this Content or
• you are granted the right to use and publish the Content either
• you have approval and authority to use the Content.

 

 

By submitting or posting Content to Sevda, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such Content by any means and by any means of distribution.

 

This licence gives us the right to make your Content available to other users and make their Content available to you.

 

This licence does not provide compensation to you for Content sent and published on the Sevda app.

 

 

All your feedback, comments or suggestions about Sevda are voluntary. We are free to use them as we see fit without any obligation to you.

 

Account

 

To use the Sevda app, you need to create an account. You are responsible for its security, so use a strong and unique password.

 

We cannot and will not be liable for any loss or damage arising from your failure to comply with our requirements and advice.

 

You can get verified in our app. After this procedure, your account will be verified and additional features will be available to you.

 

If you agree to the newsletter, we will occasionally send you certain messages. You can unsubscribe from the newsletter at any time.

 

Some alerts are part of the Sevda app and you cannot opt out of receiving them.

 

Deleting an account

 

You can terminate your legally binding contract with Amrena Software at any time by deleting your account and ceasing to use the Sevda app.

Once your account has been deleted, you will not be able to restore it. We will not retain your personal details or the Content you have uploaded once your account has been deleted. We do, however, reserve the right to retain your account details and the Content you have uploaded if you are found to have committed an offence.

 

For technical reasons, we cannot delete all the Content you have created or uploaded. Therefore, it may still be visible in Sevda even after deleting your account.

 

When your account is deleted, all rights to its use pass to us. You cannot sue us for its use.

 

 

We have the right to suspend or terminate your account at any time regardless of the reason, including if

• you have breached these Terms and Conditions;
• you are putting us at risk or exposing us to possible legal action;
• you are committing an unlawful act;
• your account needs to be deleted due to prolonged inactivity;

 

We are not obliged to send you a notice before we delete or block your account.

 

 

Paid services

 

You can buy some services from our app. For example, you can buy a premium subscription or some products that you can use as Content in our app.

 

Our paid services and products include various additional features. Using them, you can get more attention, get more dating or hide your activity from other users.

 

All premium services can be purchased after registration. You can cancel your premium subscription at any time. The subscription will automatically renew unless you cancel it.

 

We cannot guarantee a refund in the event that you wish to cancel your purchase. The availability of your refund depends on the payment method you choose. If we have a partnership agreement with the payment method you used to make your purchase, we will try to help you.

 

If your country is under sanctions, you may not be able to get paid services.

 

In-app advertising and links to other resources

 

Sevda may contain links to other resources provided by third parties. These are provided to you for your information in the form of advertisements. If you click on them, you may be redirected to third party websites.

 

These sites have their own terms of service and privacy policies. They may differ from ours. The display of third party links does not mean that we endorse their content or other resources. Nor do we have any control over the content of third party sites and we have no responsibility for them, including their compliance with any applicable laws or regulations.

 

Lawsuits and litigation

 

If we are sued because you have broken the law by using our app, we have the right to defend ourselves or settle the relevant claim as we see fit. You undertake to co-operate with us as required by the relevant claim.

 

You agree to hold us harmless and protect our directors and employees from any third party claims. You also agree to indemnify us for damages and losses caused by or arising from your unlawful conduct on the Sevda app.

 

We reserve the exclusive right to settle any claim or cause of action that is brought against us because of your conduct without your prior consent.

 

 

Changes to the Terms and Conditions

 

We may, at our sole discretion and without liability, adjust and amend ("Amendments") these Terms and Conditions at any time. All Modifications will be published on this page at the end of this document with an effective date.

 

You should review this document periodically to avoid misunderstandings and problems with the changes being made.

 

If you refuse to accept any Changes to these Terms and Conditions, you must delete your Sevda account immediately.

 

If you continue to use Sevda after the Terms have changed, you automatically accept the updated terms.

 

If any term of this agreement is found by a court of competent jurisdiction to be illegal or legally invalid, that term will be deleted from the agreement or amended without affecting the other binding terms and conditions and their validity.

Some of the information you provide to us is in accordance with the Terms of Service. For example, in order to provide you with our social networking services, you agree to provide us with your details: nickname, name, email address, photo, gender, geolocation, weight, etc.

 

Consent

 

In the privacy settings in your browser or on your device, you voluntarily consent to the use of your personal data. For example, you consent to the display of targeted advertisements to you on our app.

 

Legitimate interests

• carry out research to help develop and improve the app and services to make it even more convenient and better for you;
• respond to your enquiries to ensure that we offer a quality service and successfully resolve problems;

Age of Sevda users

Our users must be at least 13 years old (or older if your country has a higher legal age to use the app).

If we become aware that a user under the age of 13 has registered and provided his or her personal details, we will take steps to delete such a profile and all information about him or her.

If we delete your profile for breaking the minimum age rule, we may keep your email and IP address so you don't try to circumvent our rules by creating a new profile.

 

Creating an account

 

If you choose to create an account, you must provide us with certain personal details so that we can enable you to use our application.

 

You can use an alias in our app. This will be visible to all users. You can voluntarily give your real name so that you can use it to regain access to your account in case you forget your password. Your real name will not be in the public domain.

 

Some of the other details you provide when you register may be visible to visitors to your page. You can control how they are displayed in the settings.

 

You can only create one account. If we establish the fact that you are creating multiple accounts, we can block them all.

 

In order to prevent misuse of Sevda by a user whose account has been terminated, we will retain information we deem necessary to prevent that user from creating a new account in violation of our Terms of Service and to ensure compliance with all laws and legal regulations.

 

Once registered, you can view and change any information at any time, except your nickname.

 

When you first use the app, you consent to the collection of personal data for marketing and promotional purposes. If you do not want your data to be used, indicate this. In the app settings menu, you also have the option to opt out of personal data collection for advertising purposes.

 

 

You agree to update the personal data in your account in a timely manner.

 

 

Account monitoring and verification

 

Accounts in our app are monitored and verified by automated systems, company staff and moderators to monitor and review accounts (including photos and other information uploaded to user profiles) and posts for compliance with our Terms of Service.

 

If we find any accounts or posts that violate our Terms of Service, we will block or delete the account in question.

 

 

Setting up access

 

You can use your mobile device's access settings to control the app's access to some of your data.

 

For example, you can disable access to the app using the operating system. Note that this may affect the continued use of the app. It may become unusable.

 

You can also use the settings to control the receipt of notifications sent by the Sevda app.

          

 

Profile information

 

When using the Sevda app, be aware that all data you post or send in the app may be available to other users and to other third parties.

 

We advise you to be careful about the information you disclose about yourself to other users. Be cautious when posting information about your religion, health, or other issues in your profile. Information about sexual preference can be given by you voluntarily when you create your profile. You are under no obligation to do so.

 

We do not recommend that you disclose your phone numbers, credit card details, passport and other document details, email addresses, links, messenger details, full names and addresses, license numbers or other sensitive information to other users or leave this information in the public domain. This data can be used by cybercriminals.

 

Remember that the photos you post on Sevda may also reveal information about you.

 

By submitting the above information, you take full responsibility for its further use by other users of our application. If you provide or upload personal information about yourself, you consent to its processing and publication in the public domain.
